    Este trabajo versa sobre la utilidad de la implementación de nuevas tecnologías, tales como drones, fotogrametría, entornos virtuales e impresiones 3D, para la generación de conocimiento y soporte de los procesos de registro, análisis, conservación, difusión y divulgación del patrimonio arqueológico. Específicamente expondremos la aplicación de estas técnicas para la reconstrucción y recreación tridimensional de las baterías costeras y el devenir de la batalla acontecida el 20 de noviembre de 1845 en Vuelta de Obligado (Buenos Aires, Argentina). El fin último perseguido fue facilitar la trasmisión del conocimiento generado tras las investigaciones arqueológicas en el sitio, buscando lograr una representación lo más completa y fidedigna posible del proceso histórico. Asimismo, estas recreaciones no solo proporcionaron otros modos de percepción, sino que permitieron una explicación más clara y precisa del sitio, el registro arqueológico y su interpretación, favoreciendo la comprensión de la complejidad del campo bélico de la batalla. Los modelados de creación propia logrados (no procedentes de la realidad o de paralelismos) admiten no solo su uso como recurso didáctico y de divulgación patrimonial para colegas, científicos y la sociedad en general, sino que además nos permitieron generar, a modo de herramienta, nuevas preguntas o expectativas arqueológicas respecto al sitio.

    Victims have become increasingly important in the contemporary social movement. They are the protagonists of many mobilizations, demands reparations from the State, works in state agencies, and so on. This article is about the treatment in Congress of Law 27.372, commonly known as the Victims’ Law, whose objective is to modify the role of the victim in the criminal process. I will focus on the debate on the law, based on the presentations made by different crime victims, experts and officials during the treatment of the law, considering three topics of discussion that are relevant to understanding the world of victims. The first of these is about the opposition between experience and expert knowledge, the other two analyze the difference between revenge and the search for justice, and criminal policy as a moral issue.

    In this article is analized the cultural impresson from European, Asian and Afro-Caribbean immigrants in the conformation of the Costa Rica identity. A Historiographic investigation over the ethnic, cultural, economical and social contributions of the sucesive migration to the country from Europe, Asia and Africa and how molded the Costa Rican national identity and take part in the esential development of the country extending througout the period of 1840 to 1940. En el siguiente artículo se analiza la impronta cultural de los inmigrantes europeos, asiáticos y afrocaribeños en la conformación de la identidad costarricense. Se realiza una investigación historiográfica de los aportes étnicos, culturales, económicos y sociales de las sucesivas inmigraciones al país llegadas de Europa, Asia y África. Asimismo, se demuestra como estas migraciones moldearon la identidad nacional costarricense y fueron parte esencial de su desarrollo como país, abarcando el período de 1840 a 1940.

    Cuerpo físico y cuerpo vivido no deben interpretarse como dos realidades separadas, sino que representan dos aspectos distintos de la misma experiencia corporal descrita en términos fenomenológicos -- La experiencia de la corporalidad puede seguir dos direcciones: a) la primera es una dirección ascendente, que implica el desarrollo de las posibilidades de movimiento, acción y expresión del cuerpo en toda su plenitud; b) el otro camino o dirección, en contraste con el anterior, toma una senda descendente, y se halla estrechamente relacionado con la experiencia del dolor, de la limitación, de la resistencia corporal que es experimentada como oposición a la propia voluntad: es el cuerpo vulnerable -- Aquí reaparece un nuevo dualismo: el cuerpo poético de la expresión frente al cuerpo vulnerable de la enfermedad y el dolor -- Mi contribución trata de cuestionar la idea de que el cuerpo poético de la expresión artística y el cuerpo vulnerable de la vejez, de la discapacidad o de la enfermedad, pertenezcan a esferas completamente separadas -- Con este propósito, se intenta poner de relieve los múltiples puntos de intersección entre ambas perspectivas, al tiempo que se sostiene que tales intersecciones pueden llegar a ser interesantes puntos de partida de la investigación interdisciplinar. The physical body and the lived body are not two separate realities, but rather they represent two distinct aspects of the same corporeal experience phenomenologically described -- This fundamental experience of embodiment could take at least two paths: a) the first is an upward direction, which involves the development of the possibilities of movement, action and expression of the body in all its plenitude; b) the other direction, in contrast with the former, takes a downward path, and is concerned with the experience of pain, of limitation, of the bodily resistance which is experienced as oposition to one’s own will: it is the vulnerable body -- Here a new dualism reappears: the poetic body of expression and art versus the vulnerable body of illness and pain -- My contribution aims at questioning the idea that the poetic body of artistic expression and the vulnerable body of ageing, of disability or of illness belong to two quite separate spheres -- With this purpose in mind, I shall highlight the multiple points of intersection between both perspectives, and argue that such intersections may serve as interesting starting points of departure for interdisciplinary research work.

    Se analiza la construcción heracliteana del devenir en la poesía de José Emilio Pacheco, a partir de la relación triádica del pasado, presente y futuro y la forma que el escrito propone la ruptura de esa sucesión lineal por parte de sus personajes líricos. Posteriormente se profundiza en los ciclos de la naturaleza desde el enfoque filosófico de la fugacidad y el devenir en tres etapas líricas de la poesía del mexicano, la primera de las cuales está integrada por los poemarios Los elementos de la noche (1963) y El reposo del fuego (1966); la segunda, por la obra publicada desde No me preguntes cómo pasa el tiempo (1969) hasta Los trabajos del mar (1984), y la tercera, por Miro la tierra (1987) hasta Como la lluvia y La edad de las tinieblas (ambos de 2009).

    Resumen: Las políticas multiculturales, la promoción de la diversidad cultural y el reconocimiento de múltiples identidades culturales, étnicas y políticas dentro de los Estados han propiciado que el derecho del patrimonio sea discutido dentro del contexto de los derechos humanos. La participación de comunidades (especialmente de comunidades indígenas) en los procesos de patrimonialización de sus recursos culturales ha abierto el camino hacia el reconocimiento del derecho al patrimonio cultural como un derecho humano. La Convención para la Salvaguardia del Patrimonio Cultural Inmaterial, el Convenio de Faro, el informe de la experta independiente en el campo de los derechos culturales del Alto Comisionado de las Naciones Unidas para los Derechos Humanos (ACNUDH) son los más recientes desarrollos a nivel internacional en el reconocimiento de un derecho de acceso y disfrute al patrimonio cultural. Las convenciones de la Unesco y otros instrumentos jurídicos del derecho del patrimonio elaborados en el siglo XX requieren ser actualizados en su interpretación y operación para incluir la participación efectiva de las comunidades en cuanto a la repatriación y a los procesos de nominación, designación y gestión del patrimonio mundial. Abstract: Cultural heritage law has been disengaged from cultural rights recognized in international human rights instruments. Multicultural policies, the promotion of cultural diversity and the recognition of multiple cultural, ethnic and political identities have led to the right of heritage being discussed within the context of human rights. The participation of communities (especially of indigenous communities) in heritage management has opened the way towards the recognition of the right to cultural heritage as a human right. The Convention for the Safeguarding of the Intangible Cultural Heritage, the Faro Convention, the report of the independent expert in the field of cultural rights of the United Nations High Commissioner for Human Rights (OHCHR) are the most recent developments at the international level in the recognition of a right of access and enjoyment of cultural heritage. The Unesco conventions and other legal instruments developed in the 20th century need to be updated in their interpretation and operation to include the effective participation of communities in areas such as repatriation, nomination, designation and heritage management.

    Este trabajo versa sobre la utilidad de la implementación de nuevas tecnologías, tales como drones, fotogrametría, entornos virtuales e impresiones 3D, para la generación de conocimiento y soporte de los procesos de registro, análisis, conservación, difusión y divulgación del patrimonio arqueológico. Específicamente expondremos la aplicación de estas técnicas para la reconstrucción y recreación tridimensional de las baterías costeras y el devenir de la batalla acontecida el 20 de noviembre de 1845 en Vuelta de Obligado (Buenos Aires, Argentina). El fin último perseguido fue facilitar la trasmisión del conocimiento generado tras las investigaciones arqueológicas en el sitio, buscando lograr una representación lo más completa y fidedigna posible del proceso histórico. Asimismo, estas recreaciones no solo proporcionaron otros modos de percepción, sino que permitieron una explicación más clara y precisa del sitio, el registro arqueológico y su interpretación, favoreciendo la comprensión de la complejidad del campo bélico de la batalla. Los modelados de creación propia logrados (no procedentes de la realidad o de paralelismos) admiten no solo su uso como recurso didáctico y de divulgación patrimonial para colegas, científicos y la sociedad en general, sino que además nos permitieron generar, a modo de herramienta, nuevas preguntas o expectativas arqueológicas respecto al sitio.

    Victims have become increasingly important in the contemporary social movement. They are the protagonists of many mobilizations, demands reparations from the State, works in state agencies, and so on. This article is about the treatment in Congress of Law 27.372, commonly known as the Victims’ Law, whose objective is to modify the role of the victim in the criminal process. I will focus on the debate on the law, based on the presentations made by different crime victims, experts and officials during the treatment of the law, considering three topics of discussion that are relevant to understanding the world of victims. The first of these is about the opposition between experience and expert knowledge, the other two analyze the difference between revenge and the search for justice, and criminal policy as a moral issue.

    In this article is analized the cultural impresson from European, Asian and Afro-Caribbean immigrants in the conformation of the Costa Rica identity. A Historiographic investigation over the ethnic, cultural, economical and social contributions of the sucesive migration to the country from Europe, Asia and Africa and how molded the Costa Rican national identity and take part in the esential development of the country extending througout the period of 1840 to 1940. En el siguiente artículo se analiza la impronta cultural de los inmigrantes europeos, asiáticos y afrocaribeños en la conformación de la identidad costarricense. Se realiza una investigación historiográfica de los aportes étnicos, culturales, económicos y sociales de las sucesivas inmigraciones al país llegadas de Europa, Asia y África. Asimismo, se demuestra como estas migraciones moldearon la identidad nacional costarricense y fueron parte esencial de su desarrollo como país, abarcando el período de 1840 a 1940.

    Cuerpo físico y cuerpo vivido no deben interpretarse como dos realidades separadas, sino que representan dos aspectos distintos de la misma experiencia corporal descrita en términos fenomenológicos -- La experiencia de la corporalidad puede seguir dos direcciones: a) la primera es una dirección ascendente, que implica el desarrollo de las posibilidades de movimiento, acción y expresión del cuerpo en toda su plenitud; b) el otro camino o dirección, en contraste con el anterior, toma una senda descendente, y se halla estrechamente relacionado con la experiencia del dolor, de la limitación, de la resistencia corporal que es experimentada como oposición a la propia voluntad: es el cuerpo vulnerable -- Aquí reaparece un nuevo dualismo: el cuerpo poético de la expresión frente al cuerpo vulnerable de la enfermedad y el dolor -- Mi contribución trata de cuestionar la idea de que el cuerpo poético de la expresión artística y el cuerpo vulnerable de la vejez, de la discapacidad o de la enfermedad, pertenezcan a esferas completamente separadas -- Con este propósito, se intenta poner de relieve los múltiples puntos de intersección entre ambas perspectivas, al tiempo que se sostiene que tales intersecciones pueden llegar a ser interesantes puntos de partida de la investigación interdisciplinar. The physical body and the lived body are not two separate realities, but rather they represent two distinct aspects of the same corporeal experience phenomenologically described -- This fundamental experience of embodiment could take at least two paths: a) the first is an upward direction, which involves the development of the possibilities of movement, action and expression of the body in all its plenitude; b) the other direction, in contrast with the former, takes a downward path, and is concerned with the experience of pain, of limitation, of the bodily resistance which is experienced as oposition to one’s own will: it is the vulnerable body -- Here a new dualism reappears: the poetic body of expression and art versus the vulnerable body of illness and pain -- My contribution aims at questioning the idea that the poetic body of artistic expression and the vulnerable body of ageing, of disability or of illness belong to two quite separate spheres -- With this purpose in mind, I shall highlight the multiple points of intersection between both perspectives, and argue that such intersections may serve as interesting starting points of departure for interdisciplinary research work.

    Se analiza la construcción heracliteana del devenir en la poesía de José Emilio Pacheco, a partir de la relación triádica del pasado, presente y futuro y la forma que el escrito propone la ruptura de esa sucesión lineal por parte de sus personajes líricos. Posteriormente se profundiza en los ciclos de la naturaleza desde el enfoque filosófico de la fugacidad y el devenir en tres etapas líricas de la poesía del mexicano, la primera de las cuales está integrada por los poemarios Los elementos de la noche (1963) y El reposo del fuego (1966); la segunda, por la obra publicada desde No me preguntes cómo pasa el tiempo (1969) hasta Los trabajos del mar (1984), y la tercera, por Miro la tierra (1987) hasta Como la lluvia y La edad de las tinieblas (ambos de 2009).

    Resumen: Las políticas multiculturales, la promoción de la diversidad cultural y el reconocimiento de múltiples identidades culturales, étnicas y políticas dentro de los Estados han propiciado que el derecho del patrimonio sea discutido dentro del contexto de los derechos humanos. La participación de comunidades (especialmente de comunidades indígenas) en los procesos de patrimonialización de sus recursos culturales ha abierto el camino hacia el reconocimiento del derecho al patrimonio cultural como un derecho humano. La Convención para la Salvaguardia del Patrimonio Cultural Inmaterial, el Convenio de Faro, el informe de la experta independiente en el campo de los derechos culturales del Alto Comisionado de las Naciones Unidas para los Derechos Humanos (ACNUDH) son los más recientes desarrollos a nivel internacional en el reconocimiento de un derecho de acceso y disfrute al patrimonio cultural. Las convenciones de la Unesco y otros instrumentos jurídicos del derecho del patrimonio elaborados en el siglo XX requieren ser actualizados en su interpretación y operación para incluir la participación efectiva de las comunidades en cuanto a la repatriación y a los procesos de nominación, designación y gestión del patrimonio mundial. Abstract: Cultural heritage law has been disengaged from cultural rights recognized in international human rights instruments. Multicultural policies, the promotion of cultural diversity and the recognition of multiple cultural, ethnic and political identities have led to the right of heritage being discussed within the context of human rights. The participation of communities (especially of indigenous communities) in heritage management has opened the way towards the recognition of the right to cultural heritage as a human right. The Convention for the Safeguarding of the Intangible Cultural Heritage, the Faro Convention, the report of the independent expert in the field of cultural rights of the United Nations High Commissioner for Human Rights (OHCHR) are the most recent developments at the international level in the recognition of a right of access and enjoyment of cultural heritage. The Unesco conventions and other legal instruments developed in the 20th century need to be updated in their interpretation and operation to include the effective participation of communities in areas such as repatriation, nomination, designation and heritage management.
