Abstract A concept such as that of “cultural identity” seems primarily belonging to the historic-artistic domain, but understanding its meaning is also fundamental for legal scholars dealing with cultural heritage policies and administration. This article examines how that notion has been shaped by legislators at different levels, revealing specific meanings depending on whether we are dealing with international conventions or national norms, and with tangible or intangible cultural heritage. The comparison of international conventions and national legislation highlights the clash between different orientations in the cultural heritage sector, namely between nationalists and internationalists. From a regulatory perspective, this clash of interests is reflected in the opposing concepts of “common heritage of mankind” and “national cultural identity,” whose legal implications need to be addressed. These two definitions are examined and challenged in an effort to understand whether they still have a legal meaning or if they have been replaced by a “global” notion of cultural identity. From a more general perspective, through an analysis of three case studies, the article reveals the role played by legal traditions when the same matter is regulated both by national and international legislative interventions enacted in different time periods. Culture is a concept that is fed by many different elements and strengthened with the historical pro-cess; In this process, the values of the society emerge as a reflection of the culture. In this respect, culture is a whole with the values that form it, and these values are called cultural heritage. Cultural heritage, which is divided into tangible and intangible, provides information about societies. Tangible and intangible cultural heritage elements are important cultural pieces that show the common identity of the society. Cultural heritage elements are important for the recognition of society in terms of cultural, environmental and social aspects. Thanks to these elements, the society recognizes and researches its identity. In addition, cultural heritage has a connection with the economy. Due to its features such as contributing to local development and employment, its economic contribution can also be mentioned. In line with these characteristics, it should be transmitted from generation to generation and protected. The values that have been preserved can be passed on to future generations. The society has great responsibilities in the protection of cultural heritage. When the cultural characteristics that make up the society are examined, it is seen that different cultures create the mosaic of the society. Thus, cultural diversity occurs and cultural heritage elements differ. An important element that feeds the cultural heritage is the cultural differences of the societies. One of the rich cultures where cultural charac-teristics are tried to be kept alive is the Pomaks. The Pomak culture, which has a rich accumulation as a result of its traditions, customs, beliefs, various rituals, clothing elements, language and literary work features, and culinary culture, has been chosen as the research subject. While it is important to preserve and transmit the elements that distinguish a society from the others to future generations, bringing together the cultural patterns of societies that have unique cultural identity elements such as Pomaks in writing constitutes the prerequisite for the transmission of cultural heritage. In order to analyze the research question produced based on this approach, a qualitative design approach with an interpretative perspective was adopted for the discovery of Pomak socio-cultural patterns. The most important feature of the qualitative design approach is that it has the content of researching a subject in detail and in depth. In this context, thanks to the qualitative design ap-proach used in the research, the subject has been researched in depth and more detailed information about socio-cultural characteristics has been obtained. The sample of the research consists of people who have Pomak culture. The aim of the research is to determine the socio-cultural elements of the Pomak culture. In line with the stated purpose, a semi-structured interview form was prepared. Data were collected by in-depth interview technique using a semi-structured interview form. Based on the data analyzed by descriptive analy-sis, the dimensions of Pomak cultural heritage are discussed under six headings. Pomak cultural heritage dimensions have been named at various stages; traditions, literary elements, belief elements, culinary culture, clothing elements and handicrafts were named and their dimension contents were evaluated. As a result of the research, it has been determined that Pomaks have their own cultural accumulations with their cultural charac-teristics and they are trying to keep them alive today.

Multimedia technologies have recently created the conditions for a true revolution in the Cultural Heritage domain, particularly in reference to the study, exploitation, and fruition of artistic works. Most accepted perspective in the current discussions focuses on the formulation and implementation of cultural policies. While on the other hand much less space is given to local communities, their needs and expectations in relation to the available resources of cultural heritage. In this text I will discuss the issue of the functioning of various objects of cultural heritage within local communities and management of those objects at the local level. Particular emphasis will be placed on the issue of multiplicity of cultural heritage stakeholders and interactions between them.

La Virtual Archaeology ha assunto, fin dalla seconda metà del 1900, un ruolo didattico-divulgativo che si è arricchito di interessanti approfondimenti scientifici: ricostruzioni digitali di monumenti, città e territori hanno l’obiettivo di comunicare il patrimonio culturale antico in modo efficace, utilizzando strumenti di fruizione immediata per il grande pubblico, che può in tal modo effettuare una corretta, ma allo stesso tempo intuitiva, lettura del passato grazie alla verosimiglianza delle immagini rappresentate. Tali informazioni, destinate ad una fruizione aperta e facilitata, sono spesso organizzate secondo processi di gestione collegati ai database che raccolgono e mettono a disposizione la documentazione che ha guidato la ricostruzione. Tuttavia, questa “virtualità” non può in nessun caso essere comparata con l’emozione della visita a un sito archeologico che, inevitabilmente, determina un forte impatto sul processo cognitivo e sul coinvolgimento del visitatore. Il progetto di valorizzazione del sito archeologico di Santa Venera nel Cilento propone un innovativo allestimento museale in situ dei resti dell’antico santuario di Afrodite, oggi abbandonato all’incuria e all’oblio, di cui rimangono solo bassi tracciati murari, che sono stati sufficienti per una corretta ipotesi di ricostruzione ma sono altresì di difficile interpretazione per il pubblico più ampio per la difficoltà di risalire, da essi, alle perdute spazialità del monumento. I resti del santuario sono oggi parzialmente inglobati tra le mura dell’ex fabbrica Cirio che è stato individuato dalla Soprintendenza locale, in un recente studio di fattibilità, come Museo del parco destinato agli allestimenti espositivi dei materiali ritrovati. Al fine di arricchire suggestivamente l’impatto emotivo del visitatore e rendere più semplice la comunicazione del valore storico e architettonico del bene archeologico, il nostro progetto prevede un allestimento espositivo delle aree esterne circostanti al santuario, basato su un inedito gioco visivo di prospettive anamorfiche che, sovrapponendosi ai resti ancora visibili, ricostruiscono agli occhi dell’osservatore, l’originaria sagoma dell’edificio. Si tratta di una ricomposizione prospettica di segni, alcuni trascritti su pannelli espositivi dislocati lungo i percorsi del parco, altri dipinti lungo gli stessi muri della fabbrica abbandonata, che così finisce per collaborare attivamente al disvelamento delle architetture perdute, in un processo cognitivo di impatto paragonabile solo alla ben più costosa augmented reality, che tuttavia interpone un dispositivo elettronico tra l’oggetto e l’osservatore laddove l’anamorfosi permette di fruire il bene grazie alla sola visione diretta, con un coinvolgimento attivo dei femoneni psico-percettivi del visitatore, che assume il ruolo di protagonista indispensabile per ‘l’epifania della visione’.

A territorial condition for the inscription on the UNESCO Lists of Intangible Cultural Heritage was posed by two Decisions adopted by the Committee in Bali. It was thereby established that in future, the Committee will not inscribe on the Lists elements that focus on practices within the territories of States different than the ones nominating the elements. On the one hand, this condition for inscription promotes cooperation amongst State Parties in the field of Intangible Cultural Heritage, since the inscription of an element with practices performed in territories of several States can only be achieved for all the practices at stake through multinational nominations. On the other hand, the condition of territoriality may hinder inscription on the Lists and the corresponding safeguarding of elements, since it is complex to propose multinational nominations. Moreover, this condition reserves the inscription and therefore the safeguarding of one element to only its territorial State, therefore problems may arise if this State has not ratified the Convention of 2003 and so may not be able to nominate the element at stake, or if it does not have sufficient resources to do so, or otherwise does not want to nominate the element in question. Furthermore, the new condition of territoriality prevents a State Party from nominating an element that is located wholly or partly in the territory of a different State, paradoxically even if the latter consents. The condition of territoriality was then applied during the Committee’s eighth session in 2013, in relation to an element nominated by Azerbaijan for inscription on the Urgent Safeguarding List. Yet, the issue arises in regards to the legality of the Decisions of the Committee posing the territorial condition examined here.

Abstract A concept such as that of “cultural identity” seems primarily belonging to the historic-artistic domain, but understanding its meaning is also fundamental for legal scholars dealing with cultural heritage policies and administration. This article examines how that notion has been shaped by legislators at different levels, revealing specific meanings depending on whether we are dealing with international conventions or national norms, and with tangible or intangible cultural heritage. The comparison of international conventions and national legislation highlights the clash between different orientations in the cultural heritage sector, namely between nationalists and internationalists. From a regulatory perspective, this clash of interests is reflected in the opposing concepts of “common heritage of mankind” and “national cultural identity,” whose legal implications need to be addressed. These two definitions are examined and challenged in an effort to understand whether they still have a legal meaning or if they have been replaced by a “global” notion of cultural identity. From a more general perspective, through an analysis of three case studies, the article reveals the role played by legal traditions when the same matter is regulated both by national and international legislative interventions enacted in different time periods. Culture is a concept that is fed by many different elements and strengthened with the historical pro-cess; In this process, the values of the society emerge as a reflection of the culture. In this respect, culture is a whole with the values that form it, and these values are called cultural heritage. Cultural heritage, which is divided into tangible and intangible, provides information about societies. Tangible and intangible cultural heritage elements are important cultural pieces that show the common identity of the society. Cultural heritage elements are important for the recognition of society in terms of cultural, environmental and social aspects. Thanks to these elements, the society recognizes and researches its identity. In addition, cultural heritage has a connection with the economy. Due to its features such as contributing to local development and employment, its economic contribution can also be mentioned. In line with these characteristics, it should be transmitted from generation to generation and protected. The values that have been preserved can be passed on to future generations. The society has great responsibilities in the protection of cultural heritage. When the cultural characteristics that make up the society are examined, it is seen that different cultures create the mosaic of the society. Thus, cultural diversity occurs and cultural heritage elements differ. An important element that feeds the cultural heritage is the cultural differences of the societies. One of the rich cultures where cultural charac-teristics are tried to be kept alive is the Pomaks. The Pomak culture, which has a rich accumulation as a result of its traditions, customs, beliefs, various rituals, clothing elements, language and literary work features, and culinary culture, has been chosen as the research subject. While it is important to preserve and transmit the elements that distinguish a society from the others to future generations, bringing together the cultural patterns of societies that have unique cultural identity elements such as Pomaks in writing constitutes the prerequisite for the transmission of cultural heritage. In order to analyze the research question produced based on this approach, a qualitative design approach with an interpretative perspective was adopted for the discovery of Pomak socio-cultural patterns. The most important feature of the qualitative design approach is that it has the content of researching a subject in detail and in depth. In this context, thanks to the qualitative design ap-proach used in the research, the subject has been researched in depth and more detailed information about socio-cultural characteristics has been obtained. The sample of the research consists of people who have Pomak culture. The aim of the research is to determine the socio-cultural elements of the Pomak culture. In line with the stated purpose, a semi-structured interview form was prepared. Data were collected by in-depth interview technique using a semi-structured interview form. Based on the data analyzed by descriptive analy-sis, the dimensions of Pomak cultural heritage are discussed under six headings. Pomak cultural heritage dimensions have been named at various stages; traditions, literary elements, belief elements, culinary culture, clothing elements and handicrafts were named and their dimension contents were evaluated. As a result of the research, it has been determined that Pomaks have their own cultural accumulations with their cultural charac-teristics and they are trying to keep them alive today.

Most accepted perspective in the current discussions focuses on the formulation and implementation of cultural policies. While on the other hand much less space is given to local communities, their needs and expectations in relation to the available resources of cultural heritage. In this text I will discuss the issue of the functioning of various objects of cultural heritage within local communities and management of those objects at the local level. Particular emphasis will be placed on the issue of multiplicity of cultural heritage stakeholders and interactions between them.

La Virtual Archaeology ha assunto, fin dalla seconda metà del 1900, un ruolo didattico-divulgativo che si è arricchito di interessanti approfondimenti scientifici: ricostruzioni digitali di monumenti, città e territori hanno l’obiettivo di comunicare il patrimonio culturale antico in modo efficace, utilizzando strumenti di fruizione immediata per il grande pubblico, che può in tal modo effettuare una corretta, ma allo stesso tempo intuitiva, lettura del passato grazie alla verosimiglianza delle immagini rappresentate. Tali informazioni, destinate ad una fruizione aperta e facilitata, sono spesso organizzate secondo processi di gestione collegati ai database che raccolgono e mettono a disposizione la documentazione che ha guidato la ricostruzione. Tuttavia, questa “virtualità” non può in nessun caso essere comparata con l’emozione della visita a un sito archeologico che, inevitabilmente, determina un forte impatto sul processo cognitivo e sul coinvolgimento del visitatore. Il progetto di valorizzazione del sito archeologico di Santa Venera nel Cilento propone un innovativo allestimento museale in situ dei resti dell’antico santuario di Afrodite, oggi abbandonato all’incuria e all’oblio, di cui rimangono solo bassi tracciati murari, che sono stati sufficienti per una corretta ipotesi di ricostruzione ma sono altresì di difficile interpretazione per il pubblico più ampio per la difficoltà di risalire, da essi, alle perdute spazialità del monumento. I resti del santuario sono oggi parzialmente inglobati tra le mura dell’ex fabbrica Cirio che è stato individuato dalla Soprintendenza locale, in un recente studio di fattibilità, come Museo del parco destinato agli allestimenti espositivi dei materiali ritrovati. Al fine di arricchire suggestivamente l’impatto emotivo del visitatore e rendere più semplice la comunicazione del valore storico e architettonico del bene archeologico, il nostro progetto prevede un allestimento espositivo delle aree esterne circostanti al santuario, basato su un inedito gioco visivo di prospettive anamorfiche che, sovrapponendosi ai resti ancora visibili, ricostruiscono agli occhi dell’osservatore, l’originaria sagoma dell’edificio. Si tratta di una ricomposizione prospettica di segni, alcuni trascritti su pannelli espositivi dislocati lungo i percorsi del parco, altri dipinti lungo gli stessi muri della fabbrica abbandonata, che così finisce per collaborare attivamente al disvelamento delle architetture perdute, in un processo cognitivo di impatto paragonabile solo alla ben più costosa augmented reality, che tuttavia interpone un dispositivo elettronico tra l’oggetto e l’osservatore laddove l’anamorfosi permette di fruire il bene grazie alla sola visione diretta, con un coinvolgimento attivo dei femoneni psico-percettivi del visitatore, che assume il ruolo di protagonista indispensabile per ‘l’epifania della visione’.

A territorial condition for the inscription on the UNESCO Lists of Intangible Cultural Heritage was posed by two Decisions adopted by the Committee in Bali. It was thereby established that in future, the Committee will not inscribe on the Lists elements that focus on practices within the territories of States different than the ones nominating the elements. On the one hand, this condition for inscription promotes cooperation amongst State Parties in the field of Intangible Cultural Heritage, since the inscription of an element with practices performed in territories of several States can only be achieved for all the practices at stake through multinational nominations. On the other hand, the condition of territoriality may hinder inscription on the Lists and the corresponding safeguarding of elements, since it is complex to propose multinational nominations. Moreover, this condition reserves the inscription and therefore the safeguarding of one element to only its territorial State, therefore problems may arise if this State has not ratified the Convention of 2003 and so may not be able to nominate the element at stake, or if it does not have sufficient resources to do so, or otherwise does not want to nominate the element in question. Furthermore, the new condition of territoriality prevents a State Party from nominating an element that is located wholly or partly in the territory of a different State, paradoxically even if the latter consents. The condition of territoriality was then applied during the Committee’s eighth session in 2013, in relation to an element nominated by Azerbaijan for inscription on the Urgent Safeguarding List. Yet, the issue arises in regards to the legality of the Decisions of the Committee posing the territorial condition examined here.
